Right To Adoption

Supreme Court of India in a recent judgement dated Feb 19, 2014 in a matter of Shabnam Hashmi vs, Union of India that right to adopt and the right to be adopted can not yet be raised the the status of a fundamental right under the constitution of India. The Juvenile Justice Act of the year 2000 enables any prospective parent to adopt an eligible child as per procedure described by the act. Even if some personal law restrains him for adoption, discretion is left to such individual whether to go by the act or the personal law that governs it.
